1. Acceptance of Terms

By downloading, accessing, or using Gathered ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We may update these Terms from time to time. Continued use of Gathered after changes become effective constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years old to use Gathered. If you are under the minimum age required by applicable law in your jurisdiction, you may not use the App.

We do not knowingly allow children under 13 to use Gathered.

3. Use of the App

You may use Gathered only for lawful purposes and in accordance with these Terms.

You agree not to:

• Use the App in violation of any laws or regulations
• Upload, save, or link unlawful, infringing, harmful, or explicit content
• Attempt to reverse engineer, decompile, modify, scrape, or hack the App
• Interfere with the App's security, infrastructure, or availability
• Use Gathered to distribute spam, malware, or harmful code

We reserve the right to suspend or terminate access if you violate these Terms.

4. Accounts & Subscriptions

Some features of Gathered may require a paid subscription.

• Subscriptions are purchased and managed through Apple/Android's in-app purchase systems
• Payments, billing, cancellations, and refunds are handled by the respective app stores under their policies
• We do not process or store payment information directly

Free trials may be offered from time to time. After a trial ends, continued access to premium features requires an active subscription.

5. User Content & Ownership

Gathered allows you to save, organize, and interact with your own content ("User Content"), including links, media, and text.

• You retain ownership of all User Content
• We do not claim ownership over the content you save or link
• You grant Gathered a limited, non-exclusive license to store and process your content solely to operate the App

You are responsible for ensuring your content does not violate laws or third-party rights, including copyright, privacy, and trademarks.

6. AI-Powered Features

Gathered uses AI-powered tools to extract, summarize, and organize information from the content you save.

• AI output is generated automatically and may not be reviewed or moderated
• We do not guarantee accuracy, completeness, or reliability of AI-generated results
• You are responsible for how you use AI-generated information

We disclaim liability for decisions or actions taken based on AI outputs.

7. Privacy

Your use of Gathered is governed by our Privacy Policy, which explains how we collect, use, and process information.

By using the App, you consent to the practices described in the Privacy Policy.

8. Service Availability

Gathered is provided on an "as available" basis.

We do not guarantee:

• Uninterrupted access
• Error-free operation
• Permanent availability of features or services

We may modify, suspend, or discontinue parts of the App at any time without notice.

9. Termination

We may suspend or terminate your access to Gathered at any time if:

• You violate these Terms
• You misuse or abuse the App
• We discontinue the service

Upon termination, your right to use the App ends immediately.

10. Disclaimer of Warranties

Gathered is provided "as is" and "as available," without warranties of any kind, express or implied.

We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Your use of the App is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, Gathered Inc. shall not be liable for any indirect, incidental, consequential, or special damages, including:

• Loss of data
• Loss of content
• Business interruption
• Reliance on AI-generated information

If liability is found, our total liability will not exceed the amount you paid for the App in the past 12 months (or $0 for free users).

12. Indemnification

You agree to defend, indemnify, and hold harmless Gathered Inc. from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your User Content
• Your violation of these Terms

13. Governing Law

These Terms are governed by the laws of the United States (or applicable jurisdiction), without regard to conflict-of-law principles.

Any disputes shall be resolved in the state or federal courts located in the United States, unless otherwise required by law.

14. Changes to These Terms

We may update these Terms from time to time. The most current version will be available within the App or on our website.

Continued use of Gathered after changes indicates acceptance of the updated Terms.
